These Terms and Conditions (hereinafter, the "Terms") govern the access and use of the digital platform xenvico.com (hereinafter, the "Platform"), operated by Xenvico SpA, a company incorporated under the laws of the Republic of Chile, with domicile in Santiago, Metropolitan Region.
1. Acceptance of Terms
By accessing and using the Platform, you declare that you have read, understood, and accepted these Terms in their entirety. If you disagree with any provision, please refrain from using the Platform. Continued use of the Platform implies acceptance of any future modifications to these Terms.
2. Nature of the Service
Xenvico operates a real estate crowdlending platform that facilitates the connection between investors and real estate development projects in Chile. The Platform acts as a technological intermediary and does not guarantee specific returns on investments made. All investments carry risk, including the possible partial or total loss of invested capital.
3. Registration Requirements
To use the investment services, you must: be at least 18 years old and have full legal capacity; provide truthful, current, and complete information during the registration process; maintain the confidentiality of your access credentials; have a valid Chilean RUT or, in the case of foreigners, the corresponding identification document.
4. Investments and Risks
Investments made through the Platform are subject to risks inherent to the real estate and financial markets. Xenvico does not guarantee the profitability of any project published on the Platform. Projected returns are estimates based on market analysis and do not constitute a promise of profit. You acknowledge that the value of your investments may fluctuate and that there is a risk of capital loss.
5. User Obligations
The user commits to: use the Platform in accordance with current Chilean legislation and these Terms; not use the Platform for unlawful activities, including money laundering or terrorist financing; provide updated and verifiable information; not reproduce, distribute, or modify the content of the Platform without express authorization.
6. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, is the property of Xenvico SpA or its content providers and is protected by Chilean and international intellectual property laws.
7. Limitation of Liability
To the maximum extent permitted by Chilean law, Xenvico shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Platform. Xenvico's total liability shall not exceed the total amount invested by the user through the Platform in the preceding twelve months.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Chile. Any controversy arising in connection with these Terms or the use of the Platform shall be submitted to the jurisdiction of the ordinary courts of justice of the city of Santiago, Chile, with the parties waiving any other jurisdiction that may correspond to them.
